Driver Files
The registered owner of a regulated vehicle is responsible for making sure only qualified, fit drivers operate the vehicle. The owner of the vehicle can be held responsible for the actions of the driver.
The Highway Traffic Act requires Manitoba carriers maintain driver qualification files, containing:
- driver records (abstract)
- accident and violation disclosures
- annual review of driver fitness
- records of any corrective/disciplinary action
- copies of dangerous goods training materials and certificates
- recommended additional documentation
The carrier must use the information in the driver qualification file to determine whether a driver is fit to drive. These records must be available for inspection by a Motor Carrier Enforcement Officer without notice.
Recommendation
It is recommended the registered owner keep a file for each driver with the required records such as:
- application for employment
- reference checks
- road test record
