Application for New Evidence and Change in Circumstances
If you have been denied a conditional driver’s licence by the Board, you may be eligible to file an Application for New Evidence and Change in Circumstances.
New Evidence Application
You must meet all of the following conditions in order to apply for a New Evidence application:
- You were denied on the basis of being contrary to public interest
- Your suspension is longer than six (6) months
- You have new evidence that did not exist and was not available at the time of your hearing that addresses the public safety concerns outlined by the Board in their written Reasons for Denial. You will need to provide any new documentation or information for the Board to consider specifically addressing why you are no longer contrary to public interest. Examples may include: demonstrating a satisfactory period of compliance, taking a road safety course; attending counselling; attending anger management; having a support system in place for addictions
Change in Circumstances Application
You must meet all of the following conditions in order to apply for a Change in Circumstances application:
- You were denied on the basis of no exceptional hardship
- Your suspension is longer than six (6) months
- Your circumstances have changed (e.g. your spouse was previously driving you but your spouse is now unable to drive for medical reasons). You will need to provide any new documentation or information for the Board to consider specifically addressing how your circumstances have changed.
If you are denied on both grounds (no exceptional hardship and contrary to the public interest), it is required that you provide new evidence and information addressing how your circumstances have changed to support your application however only one application and fee will be required.
In order to file for an Application for New Evidence and Change in Circumstances, you will need to provide the following:
- A fully completed Application for New Evidence and Change in Circumstances (PDF, 52 KB)
- Non-Refundable Application Fee of $75.00
- By mail: cheque or money order payable to the Minister of Finance
- In person: cash, cheque, money order, debit, MasterCard or Visa
- E-transfer available. Please contact the office for instructions.
- A copy of your driver’s abstract from MPI dated within 15 days of your application filing date
- You will need to provide any support documents previously provided that are still relevant to your appeal
- You will need to provide any new documentation or information for the Board to consider specifically addressing why you are no longer contrary to public interest and/or how your circumstances have changed.
Processing for an Application for New Evidence and Change in Circumstances (PDF, 52 KB) takes approximately two to four (2-4) weeks for a complete application. If your application is approved, you will be notified of your eligibility to submit a new Appeal Application and you must go through the entire hearing process again.
The granting of permission to file a new Appeal Application is not a guarantee or indication that you will be approved for a conditional driver’s licence. At your hearing, the Board must still consider if you have an exceptional hardship and if they are satisfied that you are not contrary to public interest.
