Revocation Hearing (Early Release)

Only the registrant, owner or additional owner of the motor vehicle at the time of the offence can apply for a hearing. A hearing fee must be paid for the application to be processed. The hearing will usually take place about two business days after the application.

The registrant, owner or additional owner, who was not the driver, may apply to a Justice to conduct a hearing to cancel the impoundment.

The registrant, owner, or additional owner, who was the driver, may apply to a Justice to conduct a hearing to cancel the impoundment when the vehicle was seized for suspended or prohibited – but not when the vehicle was seized for over .08, over .16, Refusal, Refusal FST or Refusal DRE.

The Justice will cancel an impoundment according to law.

If the impoundment is cancelled, the Justice will issue an Order of a Justice to the applicant. The Order of a Justice must be signed by the police force or RCMP detachment that seized the vehicle. The registrant can then claim the vehicle at the impound garage after paying all towing, storage and provincial administration fees. See Claiming of Motor Vehicle.

Extension Hearing

If the impoundment period has been extended, and the registrant, owner, or additional owner is ineligible to apply for a hearing, the registrant, owner, or additional owner can apply for an extension hearing to ask the Justice to cancel or reduce the extended impoundment period.

Applying for a Hearing

To apply for a hearing, the registrant, owner or additional owner must go in person to a local court office and bring the Notice of Seizure form and a piece of ID. A hearing fee of $100 must be paid for the application to be processed. The hearing usually takes place about two business days after the application.
