Statutes Administered: The Personal Investigations Act
The Act regulates the conducting of personal investigations by users, personal reporters and personal reporting agencies only in respect to applications for credit, tenancy, employment or insurance. It also regulates the type of information that can be contained in a personal report.
The Act covers factual and investigative information in a personal report. It provides for consent for a personal investigation to be conducted. lf a subject is refused a benefit applied for, the Act provides that the subject be advised of the personal investigation as well as the source from which the information was obtained.
The Act covers the procedures for filing a protest and the verification of information.
The Act provides consumers the right to access the information contained in their file from personal reporting agencies once every 6 months.
